By commissioning me (the Artist), you (the Client), are agreeing to the Terms of Service below:Any statement can be bound to change if discussed with me (The Artist), prior to the commission.I. General TermsThe Client must provide neat and precise visual references.
Ill behavior will not be tolerated, should it occur, the Artist holds every right to cancel the Client's commission.II. PaymentOnce everything is agreed upon, 50% of the commission's price will be paid upfront the Client before the Artist will begin working.
Only USD is accepted.
All payments from the Client to the Artist are made through PayPal and are non-refundable.
The Client must pay the remaining 50% to the Artist once the Artist presents the sketch and is accepted by the Client.III. ProcessThe time for The Client's commission to be completed can take up to 2 Months depending on factors such as; Health, Order of Commission, Complexity, and School or Family Issues.
If any of the factors stated above or other occurs the Client will be notified at the Artist's earliest convenience.IV. Canceling/RefundingThe Artist holds the right to cancel and refund the Client's commission at any time.
The Client has no right to cancel or demand a refund from the Artist under any circumstances after the payment has been sent to the Artist.
The Client holds the right to cancel the commission if the payment has not been sent yet.
If the Client files a chargeback against the Artist, the Client's rights to present and previous commissions from the Artist will be retracted and the Artist holds the right to sell the copyrighted artwork to new buyers.
The Client will be blacklisted from ever commissioning the Artist ever again. The Client's name will be publicly posted anywhere the Artist wishes, for others to watch out for and raise awareness. The Artist holds every right to file a complaint and will have all the rights to the money the Client has given the Artist.V. Customer SatisfactionOnce a commission is finished, the Client is allowed 3 small changes, such as coloring/marking mistakes.
Any large changes will come with an extra charge, such as an outfit change, outfit addition or subtraction, background change, or anything that makes The Artist have to redraw it completely.
If the Client's reference was unclear, to begin with, then the Client is not allowed minor changes without a fee.VI. Copyright/UsageThe Artist holds every right to the produced drawing, not the Client.
Therefore, the Artist is allowed to use the copyrighted artwork to;
a.) promote themself in any place or site;
b.) display it anywhere to their liking, and;
c.) post it wherever they want.
The Client is allowed to;
a.) use the copyrighted artwork for personal use only unless agreed otherwise;
b.) print the art,
c.) claim the right of their character(s) but not the drawing itself, and;
d.) use the art to promote themselves with proper credit given to the Artist.If the Client breaks the Copyright Infringement in any way, every right the Client had to the drawing will be retracted.The following is considered Copyright Infringement:1. Reproducing/Using the copyrighted artwork commercially (meaning making money off of it), taking credit for the creation of the artwork.
2. Removing any watermarks/signatures.
3. Altering the artwork without the Artist's consent.If not stated in the commission's pricing, the purchase of commercial rights to the artwork will always be 200% of the original price.With commercial rights, the Client is allowed to make any sort of merch with the artwork, use it in books, covers, as props, change it to their liking and promote their own brand. Credit is still required for usage of the artwork, even if altered or edited.VII. NSFWThe Artist does not accept NSFW commissions that include real people, even with their consent.
The Artist accepts NSFW commissions of original characters (eg. VTubers) if sent proof of either a NSFW tag in their socials bio or the owner of that character's consent to draw them in that manner.
